The state of California is known to take the privacy rights of its citizens seriously, especially following the passage of the California Privacy Rights Act of 2020, also known as Proposition 24. Among other things, the Act provides California residents with the right to control the use of their personal information, including limiting the use of their sensitive personal information.

Over the course of many years, there has been a general continuing trend in California towards juries and triers of fact finding tortious conduct – that is, intentional, negligent, or otherwise wrongful conduct – even in relationships that arise out of contract. Cyber Security - Jaramey Stobbe v. Acellion Inc. (USDC Case No. 5:21-cv-01353-EJD): In January 2022, Accellion Inc., a company that provides FTP (File Transfer Protocol) services to clients, agreed to the terms of an $8.1 million settlement arising from a data breach associated with an older version of their file transfer service that they had ceased supporting.
