Andrade, et al. v. South Valley Transport, Inc., et al. (Calif Super Ct. Kern Cty No. BCV-17-102063): On March 15, 2019 plaintiff Armando Andrade was awarded $1.2 million in a settlement with defendants South Valley Transport Inc. and Triple-E Trucking LLC. Plaintiff alleged that he suffered multiple complex foot fractures requiring a future ankle fusion surgery after being ran over by an asphalt transfer vehicle driven by Steven Dalke, employee of South Valley Transport, a company hired by sub-hauler and defendant Triple-E Trucking. Plaintiff alleged that defendant was negligent in the operation of the truck that struck him on the grounds that the reverse alarm did not work on the truck, and that defendant failed to maintain a proper lookout for pedestrians in the area. Defendant contended that plaintiff failed to follow his employer safety rules, and that he was under the influence of a pain killer at the time of the accident. Plaintiff was represented by Yuhl Carr. Defendants were represented by Fields Law and Traub Lieberman Straus & Shrewsberry.
