Apple Agrees To Update Airtag Warnings After Cpsc Violation Notice
The Consumer Product Safety Commission (CPSC) has reached an agreement with Apple, Inc. to enhance the warning labels on the company’s AirTags to help prevent the risk of battery ingestion by children. The product now includes a warning about the hazards associated with button cell and coin batteries.
This action comes after CPSC's Office of Compliance and Field Operations issued a Notice of Violation to Apple for failing to meet the warning label requirements mandated by Reese's Law.
Reese's Law, along with CPSC regulations, stipulates specific performance and warning label requirements for consumer products containing button cell or coin batteries. These requirements are designed to safeguard children from the life-threatening dangers of ingesting such batteries. Although Apple's AirTag, a widely used tracking device, complied with the performance standards for securing its lithium coin cell battery, units imported after the March 19, 2024, effective date of Reese's Law lacked the necessary on-product and on-box warnings about the severe injury risks posed by battery ingestion.
Apple has taken corrective measures by incorporating a warning symbol inside the battery compartment of the AirTags. Additionally, the product's packaging has been revised to include the requisite warning statements and symbols. To address the issue of units already sold that did not have the appropriate warnings, Apple has also updated the instructions in the Find My app. Now, each time users are prompted to change the AirTag battery, they will see a warning about the hazards associated with button cell and coin batteries.
CPSC reminds all manufacturers, importers, distributors, and retailers about the importance of complying with Reese's Law. Non-compliance could lead to enforcement actions. Under Section 15(b) of the Consumer Product Safety Act, these parties are required to report immediately to CPSC any information that reasonably supports the conclusion that their products do not comply with applicable consumer product safety rules or any other rules, regulations, standards, or bans enforced by the Commission.
