Trucking Company Western Express Inc. Hit with $2.7 Million Verdict After Driver Causes Pileup

Anthony Wooten v. Western Express Inc., et al. (San Bernadino Count Super Ct. No. CIVDS2013300): On June 6, 2024 a jury awarded $2.7 million to plaintiff Anthony Wooten, a driver who was injured in a crash caused by a truck driver employed by Western Express Inc. On July 23, 2018, truck driver Lorenzo Lagunas, employed by defendant Western Express Inc., left the yard of his employer without permission with the company tractor to run personal errands. During this period of time he was involved in a number of hit and run collisions with 7 different vehicles, with one of those vehicles occupied by plaintiff Anthony Wooten, who sustained injuries to his should and spine. Plaintiff argued that Western Express Inc. was vicariously liable for Lagunas’ actions, and that they were independently liable for negligent hiring due to Lagunas’ poor driving record. Defendant denied all allegations, and argued that Lagunas was not operating under the course and scope of his employment duties when the accident occurred. After as 13-week trial, a jury entered a verdict in plaintiff’s favor, apportioning 70 percent fault to Lagunas and 30 percent fault to Western Express, Inc. Plaintiff was represented by Vaziri Law Group APC. Defendant was represented by Higgs, Fletcher & Mack LLP.
