Featured Verdict: Health Care Employer Hit With $9.3 Million Verdict in CRFA Leave Case

Marilyn Buron v. Occupational Health Centers of California (Ventura County Super Ct. No. 37-2021-00026852-CU-WT-CTL): On December 20, 2023 a jury entered a verdict of $9.3 million in favor of Plaintiff Marilyn Buron and against Occupational Health Centers of California in a CRFA leave case. Plaintiff, an occupational therapist, was employed by Occupational Health Centers of California via Concentra Health Services, a contracted management company. During her employment, plaintiff was forced to take a CRFA-protected leave of absence to care for her adult-disabled son, who required life saving surgery. While on leave, defendants terminated her employment contract, and replaced her with a less qualified occupational therapist who was 41 years her junior. Plaintiff alleged that the basis for her termination was age-based and due to her relationship with her son. Defendants denied all allegations. Plaintiff was represented by Harlan Law PC and Hiller DiGiacco LLP. Defendant was represented by Jackson Lewis PC.
