On August 15, 2023 the defendants in a class action claim which included major industry players including Toyota, Kia, Hyundai, STMicro, Honda, Mitsubishi and others agreed to the terms of a $78 million settlement to resolve a class action claim regarding faulty airbags that were used in vehicles spanning between 2011 and 2019. Plaintiffs claimed that the affected vehicles were subject to a condition called “electrical overstress” which among other things, caused the airbags to fail during a collision. Plaintiffs alleged that defendants were aware of this defect and sought to recover reimbursement for out-of-pocket expenses associated with the recall, an extended warranty on replacement parts and payment to class members in the amount of $250 per individual. Defendants denied all contentions leading up to the settlement. Plaintiffs were represented by Baron & Budd PC. Defendants were represented by Shook, Hardy & Bacon LLP.
