John Burnell, et al. v. Swift Transportation Co. of Arizona LLC (Central District Court No. 5:10-cv-00809-VAP-OP): On April 28, 2022 defendant Swift Transportation Co. of Arizona LLC agreed to the terms of a $7.25 million settlement to resolve the claims of a class action wage and hour case. Plaintiffs alleged that the trucking company failed to provide meal and rest periods, failed to indemnify, failed to provide accurate wage statements, failed to timely pay wages, unfair competition and also sought to recover damages under the Private Attorneys General Act. After attending mediation and failing to come to an agreement, the parties agreed to an informal compromise which was later affirmed in a settlement agreement approved by the court in the amount of $7.25 million. Plaintiffs were represented by James Hawkins APLC, Marlin & Saltzman LLP and Setareh Law Group.
