Featured Settlement: Food processing company agrees to $18 million settlement to resolve wage and hour class action.
Moises Negrete, et al. v. Conagra Foods, Inc., et al (USDC Central District No. 2:16-cv-00631-FMO-AJW): On January 14, 2022, defendant Conagra Foods, Inc, a food processing facility, agreed to the terms of an $18 million settlement to resolve a class-action matter concerning underlying claims of wage and hour violations. Plaintiffs, who were hourly, non-exempt workers alleged that defendant failed to provide meal and rest periods; failed to pay proper wages due to improper time-clock calculations; failed to provide accurate wage statements and engaged in unfair business practices. Defendant denied all allegations, claiming that they were operating under the parameters of the law. The class remembers received compensation of either $5,000 or $10,000. The settlement also provided for $6 million in attorneys fees and costs of $700,000. Plaintiffs were represented by Matern Law Group PC and Rastegar Law Group APC.
